Violent Crimes Under S.C. Code § 16-1-60
When you or a loved one is charged with a violent crime, the decisions made early in the case are of critical importance. South Carolina law identifies specific offenses as violent crimes under S.C. Code § 16-1-60, including murder, attempted murder, voluntary manslaughter, assault and battery of a high and aggravated nature, armed robbery, and first-degree burglary.
The consequences can begin well before trial. Depending on the allegations and circumstances of the case, an arrest may be followed by pretrial detention or restrictive conditions of release, including electronic monitoring or house arrest.
Sentencing Consequences
The potential consequences of a conviction can be equally serious. Under S.C. Code § 17-25-45, certain offenses are classified as “serious” or “most serious” for purposes of South Carolina's recidivist sentencing law, known as the Three Strikes Law. Depending on the offense and a person's prior convictions, the statute can require a sentence of life imprisonment without the possibility of parole.
As a former Senior Assistant Solicitor in South Carolina's 15th Judicial Circuit, Dylan Bagnal has experience trying murder and narcotics trafficking cases.
